These Terms of Service govern your use of Vibeshootit, operated by Omni Horizon Tech Limited. By accessing or using the platform, you agree to be bound by these terms. Please read them carefully.

1. Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and Omni Horizon Tech Limited ("Company," "we," "us," or "our"), a company registered in the United Kingdom. By accessing or using Vibeshootit (the "Service"), you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent and warrant that you meet these eligibility requirements and that all registration information you provide is truthful and accurate.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.
4. Using Vibeshootit
You agree to upload only content you own or have the legal right to use. Generated images are available for your personal and commercial projects, but you may not resell, sublicense, or redistribute the Service itself, its underlying technology, or AI models. You may not use automated scripts, bots, or other means to access the Service without our prior written consent.
5. Credits & Subscriptions
Each photo generation consumes credits. Purchased credits and active subscription plans are non-transferable. Subscriptions automatically renew at the end of each billing cycle until cancelled. You may cancel your subscription at any time, but cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis when there is a verified platform issue preventing delivery of the Service.
6. Payments
Payments are processed through vetted third-party providers (such as Flutterwave). By making a purchase, you authorize us to charge your selected payment method. All prices are displayed in the applicable currency at checkout. We reserve the right to modify pricing at any time, with changes taking effect at the start of your next billing cycle.
7. Acceptable Content
You must not upload explicit, hateful, defamatory, or illegal material. You must not use the Service to generate content that infringes on intellectual property rights, depicts real persons without their consent in a misleading or harmful manner, or violates any applicable law. We reserve the right to suspend or permanently terminate accounts that abuse the platform.
8. Prohibited Activities
You agree not to: (a) scrape, data-mine, or harvest any content from the Service; (b) circumvent or attempt to circumvent security features; (c) impersonate any person or entity; (d) use the Service for commercial spam, harassment, or any unlawful purpose; (e) reverse-engineer, decompile, or disassemble any part of the Service; (f) interfere with or disrupt the integrity or performance of the Service.
9. Intellectual Property
The Service, including its design, code, AI models, trademarks, and all related intellectual property, is and remains the exclusive property of Omni Horizon Tech Limited. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. Nothing in these Terms transfers any ownership rights to you.
10. User Content
You retain ownership of the images you upload. By uploading content to the Service, you grant us a limited, non-exclusive licence to process, store, and use that content solely for the purpose of providing and improving the Service. Generated outputs are available for your use subject to these Terms.
11. Service Availability
We strive for continuous uptime, but Vibeshootit may occasionally be unavailable due to maintenance, updates, or circumstances beyond our control. We do not guarantee uninterrupted or error-free operation. Features and functionality may change as we improve the experience, and we reserve the right to modify or discontinue any aspect of the Service with reasonable notice.
12. Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OMNI HORIZON TECH LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Omni Horizon Tech Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.
15. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. You agree to attempt to resolve any dispute informally by contacting us before initiating formal proceedings.
16. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
